Welcome to
the SGS Remote Approval customer web portal (the “Site”) owned and operated by SGS
International, Inc., a global leader in providing package designs and packaging
graphics to the consumer packaged goods industry (“SGS” or “we”). The purpose of this Policy is to inform users
of the Site (“you”) as to: (1) what information we
may collect from or about you in connection to your use of the Site; (2) how we
may use and share such information; and (3) your rights and choices regarding
such information. This Policy
constitutes an integral part of the terms and conditions that govern the use of
the Site.
PLEASE READ THIS POLICY CAREFULLY BEFORE USING THE SITE. By using the Site, you, on behalf of yourself and
the business entity which you are representing or are affiliated with,
acknowledge that you have read and understand this Policy in its entirety, and
agree to be bound by its terms.
SPECIAL
PURPOSE OF THE SITE
The
Site is intended for access and use solely by SGS clients and users that have
registered on the Site or have been authorized by the SGS clients to access and
use the Site using the SGS client’s password and/or username, and is not
designed or intended for the general public.
SGS does not knowingly collect personal information from anyone under
the age of 13. In any event, no one
under the age of 18 is permitted to register on the Site or use or access the
Site. By using the Site, you represent
and warrant that you or the business entity which you are representing or are
affiliated with is a current client or customer of SGS, or has purchased or
used SGS products or services within the last 12 calendar months at the time of
your use. SGS reserves the right to
cancel your registration and terminate and disallow your use
of the Site at any time without warning, if we have any reason to believe that
you have misrepresented the foregoing or that you are under the age of 18.
Changes
and updates
SGS
reserves the right to change and update this Policy at any time in its sole
discretion. For example, SGS may amend
this Policy to incorporate additional rules and policies as may be established
by SGS from time to time, and/or to comply with or adopt any changes in law or
industry practices. If we make changes
to this Policy, we will announce and post such changes on the Site. We may also notify you of such changes via
email and may ask you to affirmatively consent to and
accept the changes at the time of your next account login on the Site. By continuing to use the Site after such
notice and/or consent, you are bound by our Privacy Policy as modified.
COLLECTION AND USE OF Information about you
1. Personal
Information. This is any information by which you can be
personally identified. When you register
on the Site, you will be required to provide certain personal information to
us, which may include your first name, last name, title, company, mailing address,
email address, telephone number, mobile phone number, mobile phone service
provider, and system preferences. Also,
in such case, you will be required to provide a username and password for your
account login. The foregoing information
will make up your account and profile information on the Site. We collect and use the aforementioned
personal information for our internal purposes only, including, but not limited
to: (1) operating,
maintaining, administering and monitoring the Site; (2) setting up,
maintaining, monitoring and supporting your account on the Site; (3) processing
your orders and transactions; (4) providing you with products and services
requested by you; (5) enabling you to view, submit, upload, download, store,
transmit and exchange transaction and project documents on the Site, such as
purchase orders,
artwork files, reference documents, logos, CAD drawings, quotes, price lists,
and invoices; (6)
notifying and communicating with you on matters and issues concerning the Site,
your account, and your activities on the Site; (7) responding to your questions
and requests; and (8) sending you, subject to your right to opt-out, our
electronic newsletters, advertisements, and promotional/marketing emails and
announcements (collectively “Electronic
Mailings”).
2. Log File
Data and Cookie Session Information. Our
web server automatically generates log files that may contain data linked to
individual users, such as their IP addresses, ISP domain names, browser types, operating
systems, referring/exit pages, date/time stamps, clickstream data, etc.
Also, to
the extent you have enabled “cookies” in your browser, we may use “cookies” to collect session information about your
visits to the Site. We use log file data
and cookie session information internally for the
operation of the Site as well as to generate and analyze aggregate data about
our users as a group. If we report information
about the Site to our partners,
sponsors and investors, we only report aggregate data and not information that is linked to
individual users.
3. Aggregate
Data. This is any information collected or compiled in aggregate form, without
identifying any user individually.
For example, we may collect aggregate tracking information derived
mainly from tallying page views throughout the Site. Also, we may gather or compile demographic
and/or other aggregate data about our users as a group. We use aggregate data to
administer and monitor the Site, to analyze Site traffic and usage patterns and
trends, to improve the functionality of the Site, and to enable us to
personalize and better users’ experience on the Site. We may report aggregate data about the Site
to our partners, sponsors and investors, and may also share such data with
outside vendors for market analysis, marketing and/or promotional purposes.
SHARING OF INFORMATION ABOUT YOU WITH THIRD
PARTIES
SGS does not
knowingly share your personal information with third parties for their
marketing use.
By registering on
the Site or otherwise voluntarily disclosing your personal information to us,
you acknowledge and agree that we may share and disclose your personal
information in the following circumstances:

We may employ outside contractors, vendors and service
providers to perform services for us in connection with the Site, and may share your personal information with such contractors, vendors and service providers to
the extent necessary for them to perform such services. For example: IT service providers may be given access to your personal
information as necessary to perform support and/or maintenance for the operation of the Site, such as data
backup and storage. We require that our contractors, vendors and service
providers limit their use of our users’ personal information solely to the
purposes for which it was disclosed by us, and that they maintain the
confidentiality, security and integrity of such information and not make any further disclosure to
others.

We may disclose your
personal information to others
as required
or permitted by law or in response to a court or government
order or subpoena or, in our good faith belief, as
reasonably necessary to: (1) comply with legal process, or cooperate with law
enforcement; (2) enforce this
Policy and/or other
terms and conditions governing the use of the Site; (3) respond to third-party
infringement claims relating to any information or material you furnish to us;
(4) respond to an emergency; and/or (5) protect the
rights, property or safety of SGS, the Site, and/or the public.

If SGS is acquired by or
merged or consolidated with or into another entity, or if all or substantially
all of our assets or businesses are
sold or transferred to another entity, your personal information may be
transferred to such entity as part of the transaction.
User Choices
and Opt-out
As a
registered user, you may manage your account and profile through the user control
panel (account manager) feature on the Site, including updating your personal
information and managing your
status notification frequency.
To the extent you receive Electronic Mailings from
us, you may at any time opt out of receiving the same by emailing your request to
enterprisesupport@sgsintl.com, or by using the “opt
out” or “unsubscribe” mechanism provided in the Electronic Mailings you already received
from us. We generally process such request within 5
business days after receipt. Once you opt-out is processed, we will not reuse your
email address for future Electronic Mailings, unless you rejoin our mailing
lists or otherwise opt in to receive such mailings from us.
As a registered user, you may at any time
request to close your account on the Site by sending an e-mail request to
enterprisesupport@sgsintl.com. We
generally process such request within 3 business days after receipt. However, for your safety, we may ask you to
verify and confirm your request prior to closing your account. Once your account
is closed, we will cease using your personal information for all
purposes, EXCEPT that we may retain and disclose
your information as required or permitted by law or in response to a
court or government order or subpoena or, in our good faith belief, as
reasonably necessary to: (1) comply with legal process, or cooperate with law
enforcement; (2) enforce this
Policy and/or other
terms and conditions governing the use of the Site; (3) respond to third-party
infringement claims relating to any information or material you furnish to us;
(4) respond to an emergency; and/or (5) protect the
rights, property or safety of SGS, the Site, and/or the public.
Cookies
The Site may use cookies, which is a small encrypted data string stored on your computer or device. Cookies help us deliver content specific to
your interests and permit our servers to
recall information from your previous visits to the Site. We may use
internally for the operation of the Site information collected from cookies
together with personal information disclosed by you. We do not, however, use cookies to access
information on your computer or device. Most Internet
browsers
allow you to adjust the settings to prevent cookies from being stored on your
computer or device.

The
Site may contain links to third-party websites.
SGS does not own,
control or operate such linked sites, and is not responsible for the privacy
policies or practices of such
linked sites. Privacy policies and practices for such linked sites may differ from our privacy policy and practices. You access and use such linked sites entirely and
solely at
your own risk. We urge you to read the
privacy policies of such linked
sites before
disclosing your personal information on such sites.
Security
We understand the
importance of protecting the security
and integrity of personal information that our users have shared with us. Unfortunately, no data transmission over the
Internet and no data storage can be 100% secure. Consequently, while we will endeavor to safeguard your personal information against
unauthorized access and disclosure, we
do not warrant or guarantee the security of any
information you transmit to,
from or on the Site. We will notify you in the event we become aware of a breach
or suspected breach in the
security of your personal information stored by us.
By registering on the Site or otherwise disclosing your email address to
us, you consent to being notified by us via email in the event of a breach or
suspected breach in the security
of your personal information stored by us.
All bank account information provided by you in connection with a
specific transaction on the Site will be
encrypted using the standard Secure Sockets Layer (SSL) protocol, and we do not
retain such bank account information after the processing of your transaction
is complete.
